ORDERING INSTRUCTIONS AND CONDITIONS OF SALE


MAIL ORDER CONVENIENCE
Unlike a book or a CD, the items we sell tend to be big time expenditures and important decisions for most of our clients. We're old fashioned, we'd like to talk to you prior to you making a purchase so that we know who we're doing business with and vice versa. By doing this, we can be certain that every order goes smoothly and any mistakes that can be avoided, are avoided. 

Since most items are one-of-a-kind, we strictly adhere to a "First Come - First Serve" policy. Therefore, to avoid disappointment, we strongly suggest that you phone or fax us, expressing your interest in a specific item, at your earliest convenience. Our mail order phones are open M-F between 10:30-6pm EST. (Saturday by chance). Faxes are monitored 24 hours a day.  

All prices quoted include our 5% discount for cash, check, money order, traveler’s checks, and bank wires. Remember, for all other forms of payment, layaway’s and COD’s you must add 5% to all prices shown.

We reserve the right to refuse, for any reason, credit card payments for internet sales.

Sales Tax
At this time we are only required to collect sales tax from GA residents who are purchasing items for their own use and not for out-of-state shipments.

 
Shipping/Handling/Insurance
We guarantee safe delivery via US Post Office or United Parcel Service. Charges vary from $20-$50 depending on insurance value and speed of delivery.

All showroom sales are final unless otherwise noted in writing.
 
 
Mail-Order Refund Policy
SHOWROOM BY APPOINTMENT
New watches and/or special order merchandise are not subject to return or cancellation.   All Merchandise presented to the customer as New is considered as such when the item has never been sold to a Private Party. Some items have to go through multiple dealers and registration to even get them into the country! As we take every precaution we can when evaluating merchandise for purchase from our Sources, some of the items we have for sale have been sitting in a Jeweler's showcase for months or even years (that's how we beat them down on the price!) Most of the items we sell are Mechanical Masterpieces and have hundreds, sometimes thousands of very tiny moving parts, which need periodic maintenance. 

Many new and pre-owned watches are shipped in original factory containers when available. However, Capetown reserves the right to substitute a high-quality Capetown jewelry or watch box. If you need a factory box, you must let us know and confirm it's availability. 

If shipping charges have been waived on a purchase that is being returned, CDC reserves the right to deduct applicable shipping charges from the refund. 

All merchandise is sent out in undamaged condition. Any damage to merchandise must be reported immediately. If upon examination, Capetown determines that the damage was the fault of Capetown, Capetown reserves the right to repair item to original condition. If damage occurs while in the client's possession, the client is responsible for all damage, and the cost to repair or replace the damaged merchandise will be deducted from their refund. We reserve the right not to accept damaged merchandise for any reason.

Should a package be damaged or misplaced during shipping, Capetown reserves the right to replace the lost or damaged item with an item of like kind. 

In the case of sizing, Capetown will work with the client to size the merchandise correctly. However, if sizing is performed by a third party, Capetown will not be responsible for damage to the merchandise. The client can call Capetown's Toll-Free number and Capetown will walk them through the resizing process.

It is suggested that prior to ordering a new watch, the client should visit a local jeweler to try the watch on to see how it accommodates itself to his wrist. (Our staff can be helpful in guiding you to a jeweler in your trading area.) This is much more satisfactory than buying blind or from a picture on the web. 

Any exceptions to the above New Watch or Special Order Watch Policy must be duly noted on invoice.  

Most other items (diamond solitaires, jewelry, pre-owned watches) carry a comprehensive money back guarantee (excluding shipping charges), providing the following conditions are met.

  1. Upon receipt of merchandise you must immediately (that same day) advise us of your intent to return purchase. Contact must be made by telephone. No e-mail, snail-mail, or faxes.

     

  2. All return packages must have Capetown's return authorization number prominently displayed on box. This number will be provided when you notify us of your intent to return.  Packages returned without a Capetown Return Merchandise Authorization Number (RMA #) will not be accepted.

     

  3. Item must be returned, pre-paid and insured, via UPS Next Day Air Service. Additionally, it must be received back at our Atlanta Mail-Order Center within 5 days of the shipper's recorded delivery date. (In other words: If you received your package on Monday, we must get it back by the following Friday.) Remember: Do not use Federal Express. They do not insure jewelry.

    If you're wondering why we're in such a hurry to get the merchandise back, it's because when we sell one of our consignment items, we notify the person who owns it immediately, and send them their money as fast as we can. We want to make sure that no one gets hurt in the return process, especially the customer. Also, the faster you send something back, the faster we can fix the problem. Additionally, if we need to get something else for you instead of the merchandise you're returning, we want to make sure we can do it quickly. If the item you have purchased requires replacement, we must have the item you wish to return in hand before the replacement can be sent.

     

  4. Item must be returned to us in the same condition as you received it. Remember, while it is in your possession, you are responsible for loss, damage, or wear.


No refunds on repairs as they carry Capetown's One-Year Warranty.

Jewelry Buy-Back Policy
Occasionally, when we present an item for sale on our website, it could be of such a spectacular rarity, quality, or value that we would not mind owning that piece again in the future.  Particularly in the case of high quality diamonds or gemstones or established works of art.

This policy is made for the convenience of the buyer and it is done to ensure a significant supply of quality items for us to re-offer for sale.  There is a period of time required for the appreciation of an item to become even with its original sale price.  Thus, the buy-back period generally should be at least three years from the date of purchase. 

Unfortunately, there are times when Capetown's finances are in a downward trend and it may not be fiscally possible for us to liquidate your item on short notice.  However, in that case, we will provide you with free brokerage.  We will pay to have the item reappraised with a current laboratory evaluation and will photograph the item and advertise the item on our website at no cost to you.  

Our best advice is that if you're buying a credentialed piece of jewelry and you think you may have to liquidate it in less than a year, don't do it without first discussing it with us.

The buyer needs to bear in mind that the conditions of any buy-back guarantee is that the item be received in the same condition as it was sold in.  If the item shows wear that was caused while in the buyers possession, it may not be worth as much on a buy-back basis. 

The buyer should be cognizant of the mercurial nature of the American economy.  There are times when there are simply no buyers about.  We're very cautious to only offer a buy-back policy on items that are tightly controlled by a strong consortium - analogous to the diamond syndicate - or on durable items that, by virtue of their rarity, would not present too much of a hazard to inventory. 

Most pieces, especially diamond and exceptional colored stone jewelry pieces (i.e. rubies, emeralds, sapphires) in which the size of the stones approaches two to three carats, are generally quite liquid. Again though, this will always depend on the fluctuating market. 

If you've bought a spectacular piece of jewelry from Capetown and the occasion arises in which you or your loved one must raise cash and our company is in a stable fiscal period, we would certainly be available to loan you money using that piece of jewelry as collateral.  The current rate on loans to past clients as of December 2005 is 4%.  But, of course, world financial conditions can change this figure at any time. 

Any jewelry buy-back guarantee cannot be transferred except to immediate family members.

Watch Buy-Back Policy
Occasionally, when we present a pre-owned watch for sale on our website or in a printed ad, it could be of such a spectacular rarity, quality, or value that we would not mind owning that piece again in the future.

Our longevity in business gives us the edge on knowing what merchandise will be safe for us to inventory.  A well cared for, spotless Rolex "President" always has value, particularly due to the fact that Rolex continuously and periodically raises their retail prices.  As the standard of living improves in America, fewer and fewer people find themselves in the unfortunate position where they will have to sell their Rolex.  So, Rolex, Patek Philippe, and other watches of that ilk are always desirable to us and if we can help one of our clients, its always our policy to do so.

LAYAWAY / "HOLD" DEPOSIT POLICY
On selected merchandise, Capetown may opt to accept a good faith deposit on merchandise within Capetown's inventory.  At that time, dates and parameters must be set up for payment.  The buyer must realize that they are asking us to hold a costly item from resale predicated on their promise to pay all payments as well as the balance in full by the dates designated at the time the layaway began.  Bear in mind that the deposit given towards a layaway is a bond that you will keep your word and finish paying off the item.  Unless other arrangements have been made, when there is a failure to make any payment or when a layaway is cancelled, the deposit will be nonrefundable.

Credit Slips
Credit slips can only be used to make purchases of any of Capetown's regular in-stock merchandise or repairs, not toward consignment items or Special-Order merchandise. Credit slips must be announced beforehand to avoid any errors or misunderstandings.

Warranty
In regard to jewelry, all appraisals shown are educated “guesstimates” based on national market prices. Gem authenticity, quality, and weights as well as metallic content are guaranteed to be as represented. None of the watches or jewelry listed in the consignment sections of this website are new. All consignment items have been checked and/or serviced by our technicians.

This specific warranty shall be indefinite.  Any unpleasant surprises that come up in the future regarding authenticity will be grounds for a full refund or a replacement as the item was originally represented.  This warranty can be passed on to another generation, (either family or third-party buyer).

We will be happy to transfer the warranty as long as the watch has been sent in to us for regular servicing. However if the servicing was done by someone else, it may void the warranty.

We cannot be held responsible for the consequences of any work done to your watch by technicians other than those working for Capetown Diamond.  Leave it to us.

If you live in an area where we have a service depot, we'd be happy to give you free battery changes.  The wrong person putting in a battery can do some terrible damage.  The watch could lose its pressure proof integrity, the technician could short out a very expensive circuit so ABC - Always Be Careful.

In the instances where Capetown Diamond Corporation makes exceptions to the above referenced refund policy, a 15% restocking fee of the selling price will apply.

Exclusions: Normal wear and tear, obvious misuse, and water damage.

Warranted repairs must be sent to one of our National Service Centers with a copy of your bill of sale.

 

You can be assured that all merchandise is guaranteed to be as described on the web.  This warranty is forever.  We're always prepared to stand behind everything we sell.  So, if five years later you find a problem with an item you bought from us, as long as we both have a record of the sale, we'll make it right. Rest easy.

In regards to fine jewelry:  we often encounter a gift-giver that needs a couple of extra days. This needs to be addressed before we ship out the item. Any exceptions to our return policy must be noted on your bill of sale.

For those of you curious to know why we have adopted this strict return policy, be advised that a lot of items are consigned to us by people who are in dire need of the money.  Therefore, we must know ASAP if the piece is sold so that we can pay them quickly.  Additionally, we have had some incidences where insincere customers have made purchases for the sole purpose of using the items over a few days or a weekend and then returning them.
